Privacy Policy
Nightscaler is a service operated by Dversion (Dutch Chamber of Commerce / KvK 97223948), "we". This policy explains which data Nightscaler processes, why, and what your rights are. Questions: info@nightscaler.com.
1. Data we process
- Account data: your email address and login details.
- Meta (Facebook) data: after you connect your account: the ad accounts, campaigns, ad sets and ads you select, their performance metrics (spend, impressions, clicks, add-to-carts, purchases), status and budgets, and ad creatives (images and video frames) used for creative analysis. We store an access token to read this data and, when you allow it, to pause, resume or change budgets.
- Shopify data: after you connect your store: orders (date, amount, currency, products, cancellation status and UTM/landing-page attributes), products and store analytics such as sessions and add-to-carts. We do not request customer names, addresses, email addresses or phone numbers.
- Device data: if you enable notifications, a push subscription for your device.
2. Why we use it
Only to provide the service you asked for: showing your ad and sales data, applying your kill and scaling rules, sending you notifications and analysing which creatives perform best. The legal basis is the performance of our agreement with you (art. 6(1)(b) GDPR).
3. What we never do
We do not sell your data, do not use it for advertising, do not share it with other users and do not use Meta or Shopify data for any purpose other than providing Nightscaler to you.
4. Processors
We use Cloudflare (hosting and storage) and Anthropic (AI analysis of ad creatives; images are sent only to classify them and are not used to train models). Data may be processed outside the EU under standard contractual clauses.
5. Security
Access tokens are stored encrypted. All traffic uses HTTPS. Only you can see the data of your account.
6. Retention
We keep your data as long as your account is active. Cached ad and order data is refreshed regularly. When you disconnect Meta or Shopify, or delete your account, we delete the related tokens and data within 30 days.
7. Your rights
You can request access, correction, deletion or export of your data, and object to processing, by emailing info@nightscaler.com. You may also complain to the Dutch Data Protection Authority (Autoriteit Persoonsgegevens). See Data deletion for how to remove your data.
